I was arrested in October, finally put on PTI, March 5th. I didnt stop smoking till March 4th, and it takes a month to get out of your system. I have to submit a negative test by April 5th. Just in case I am not clean by the time I take the test, before the 5th, what will most likely happen?
Make sure you do everything required. Explain the situation to your officer on the front end. They are well aware that drugs stay in your system for a period of time. Subsequent tests will take on more importance if you test positive the first one. Being candid is probably your best bet. If you have an attorney, discuss it with them and find out about Dallas requirements.
This response does not create an attorney client relationship nor should the advice be relied upon because it is not specific to your legal situation. Before you depend on legal advice, you should retain competent counsel.
If you told them at the time you signed up for the PTD that you smoked the day before, then they might let you slide one last time - but they might not because most authorities believe that 30 days is sufficient to get your system cleaned out naturally. Moreover, PTD is a gift and the State can take it away for no reason whatsoever. A dirty UA, at least in Harris County, would result in a return to court and prosecution.
