The plaintiff was granted a monetary judgment, from small claims court, but the defendant never made any payment to this plaintiff. The plaintiff proceeds to collect on the judgment by filing sheriff service to order the defendant to a court ordered collection hearing. The defendant claims that there is someone else with his same name & that this defendant should not have pay on the judgment. How does this work? What happens in this situation?
A judge will decide. Usually the addresses will not match up, and for sure, the social security number shouldn't do so either. Hope this perspective helps!
