Attorney has to give your file....you also need additional legal advice on the filing of the Chapter 7 at this time with the accident pending...explore all your options........don't delay.
The answer is purely for information or educational purposes. On this forum there IS NO ATTORNEY-CLIENT PRIVILEGE OR LEGAL ADVICE being offered from me or any other lawyer on this forum. ALL information is educational and/or informative. If you believe you have a case I strongly recommend you contact local counsel or a firm that associates with local counsel who can complete a full review of all the facts in the case.
Your current attorney will have to give your file to you or your new attorney, but you may have to first pay any outstanding fees and costs before the file is released if your attorney asserts a retaining lien. Consult with your new attorney regarding your rights.
