My husband and I got divorced last year. We agreed to that he will have him every other year on his birthdays, and every other year for Christmas and he is to pick him up each time. So he never picked him up the days she supposed to and brought him earlier than should. He was also supposed to pick him up July 1 for the entire month, today is July 14th he still haven't showed up. What actions should I take? If he shows up in few days Do I have the right not to give him my son because he is so late? I don't want him not to follow court orders and do whatever he wishes. Any advice appreciated.
Child custody is an very difficult ar3ea of law. Consult a experience family law attorney to understand your rights and how to sassert th3m in this situation.
If he is not following the order, you can file a modification fo the custody order to change the custody arrangement that would cut his time with your son. Technically, your ex still has a right under the agreement to see your son even if he picks him up late. However, you also have a good argument not to comply. Unfortunately, there is not an easy answer to your question. You should privately consult with a family law attorney to review your order and on how to proceed.
