I was arrested for marijuana and my public defender is working on getting my case thrown out. I have never violated my PTR until now. I have not taken any benzos and am not sure why it came up positive. Will I be issued a new court date for the violation or will I go to jail for violating at my next court date? I am freaking out. I just need to know what to expect. I’ve been on this PTR for 7 months now and my case keeps getting continued so I really can’t afford to be in jail if it keeps getting continued because it could be another 7 months. Please give me some advice.
I can;t tell you what will happen but I can tell you this.
Your PTR is in serious jeopardy.
If I were you then I would run (not walk) to the nearest lab and get an immediate blood test.
The only way to disprove a +++ U/A is with a contemporaneous negative U/A.
Wishing you luck and hoping that I have been helpful in answering your question.
First, second and third: No attorney-client relationship exists by virtue of any Q&A with Michael A. Haber, Esq. on Avvo. Fourth: Anything that you post on Avvo (or on similar sites) or on any social media is by its nature public. I am an attorney here in Gulf Breeze. When is your next court date? Please give me a call. Our local Public Defenders are great, however, they are very overworked. Please consider hiring a private attorney who will have more time.
Your bond could be revoked. I agree with the previous answer: if you haven't taken benzos, run to a lab and get tested asap.
not intended as legal advice and this answer does not create an attorney/client relationship.
