What are you going to court for? Criminal case or family law case? You are very unclear!If he is in jail in another state then you will get what you want in Family court case since he is incapable of appearance unless he has an attorney

I guess the parent in jail would lose custody.... or at least you can ask that the custodial schedule be modified because the other parent now lives out-of-state.
