A trustee was appointed by the court to sell the marital property, the proceeds of which were to have gone to the spouse who occupied the property after the divorce was finalized 7 years ago. Settlement occurred more than 120 days ago and there has been no communication with the trustee. As of 60 days ago, the court auditor had not yet received the file.
Unless the Court order specifies otherwise, the Trustee would file a report / accounting which would be audited. The interested parties all should receive a copy. First call the auditor and ask for an update. It's been 60 days. If the auditor has not received the Trustee's report ask the auditor to communicate with the Trustee and if necessary have the Court issue a " Show Cause" Order to the Trustee which will mandate that he/she must respond within a set time limit or could be removed. Another way to approach this is call the Trustee directly and ask for an update etc.
