So my sister, 18 years old, got arrested for DWI in Michigan. She got put on probation afterwards. Now, she got in a wreck in Ohio, and was arrested for having a .102 alcohol blood level, had alcoholic beverages in the car, and is now 19. She hit a sign on the road and no one else was hit nor hurt. If it matters, her friend, who was also arrested for the first DWI and on probation as well was in the car and also intoxicated, but I'm not worried about her. I was wondering what kind of charges she could be looking at, how long she could be in jail for, what fines she might get, and is she to tell her probation officer? She lives in Michigan.
You or your sister need to start contacting attorneys immediately. Use the "find lawyer" tab on Avvo to find a local attorney. There are many things that she will need to discuss. Such as - there may be a condition of probation to notify the agent of any new arrest. If she had a condition to not drink, the 0.102 shows that she drank. She could be sent to jail for any suspended time in the probation, plus the new case.
Even though it is Saturday, many attorneys have Saturday hours.
