I laid a line 16 years ago or my folks did . It was & pretty much still is the only way of getting potable water to my home without the neighbor on the other side making me pay for a road bore & half of his line when I’ve already paid for smile long ago . Verbal agreements don’t carry any clout when all 3 people who made it are dead . Can I work on my waterline even though I have no easement? And if I sell can they also maintain it as long as it is in reason? They would be buying the line when property purchased
There is no implied easement for a water line. However, if the water line has been in place for 16 years, you likely have a prescriptive easement by adverse possession. An easement would carry along the rights necessary for its enjoyment, including maintenance.
