The prosecuting attorneys argument to why I should not be granted pre trial release and remain in jail was ---
1. Domestic assault from 6 yrs previous which was a DEFERED JUDGEMENT with completion of batters program. I didnt mess up the defered by getting in trouble the whole time I was on probation.I completed& paid for my classes. I got off probation.
2. I "knowingly" kept "committing a crime" over&over. With a period length of 2 years I was being investigated for distribution of methinphetamine . (that investigation led to 2 controlled substance violations. Then while incarcerated for a month they throw a 3rd controlled substance violation because they found methinphetamine in my car they warranted)
I have not been found guilty by a judge yet..
...like the prosecuting attorneys argument w/my defered i thought couldn't be used against me/discriminated against me w/ completion of the stipulations for the defered.. Is that correct ?
Is it legitimate reasoning arguing you're a risk factor to threaten society again since " I knowingly" chose to commit the crime for a lenthly period with clear knowledge of the laws ? Insinuating I'm unlikely to comply with laws if let out....

That tells you that the prosecutor thinks you're a repeat offender and a risk to the community.
You need to get a lawyer and have your lawyer explain what's happening to you and make arguments on your behalf.

You could be facing a class B felony depending on the quantity of methamphetamine involved (more than 5g and less than 5kg). There's the potential for a mandatory term of incarceration. If you have any history of not appearing at court for whatever reason, then the state could consider you a flight risk, too.
