My husband and I have been separated for few months now . He has refused to apply for my h4 extension along with his H1 extension. My I-94 is valid till end of august. I have decided to apply for F1 and already e-filed. I need to send supporting documents of H1-B but wondering i dont have any of them. Can any one list me the H1-B documents that are needed to change of visa status as i am a dependent of H1-B.what documents of my husband do i need to provide for my h4 to F1 change of status.

You need your husband's H-1 approval notice, his last entry stamp or I-94 unless it was an extension in which case the status will be on the approval notice, and his most recent pay stub. If he will not give this to you, you must immediately retain a divorce lawyer who will file for divorce and serve your husband with an immediate demand for this documents. If your husband does not give these to you within a set period of time, for example, next Tues at 5:00, hire the attorney on Wed. Please note your husband's/the company's immigration attorney has a conflict of interest here which it is his/her duty to resolve. So, you can also contact that attorney. If he/she refuses to help you; please let me know. There are far too many so-called immigration attorney's abusing people's rights in Texas. Finally, the expiration of your status is critical here.
