My mother's tenant has not paid rent since last some and the eviction process started in September. The went to court and the judge granted the eviction but when my mother called the sheriff's office to check the status of the eviction she was advised that the tenant says that someone in the home is sick and that she filed a motion to stay. It's not fair that she is able to continue to stay rent free. Also wouldn't this motion need to be approved by a judge because my mom has not received any court summons. What do we need to do next to get this person out.
You need to go to court on the motion date and tell this to the judge. The judge will either give the Defendant more time to move or will not. In any event, you need a written order of the judge's ruling to take to the Sheriff. When the Defendant filed the motion this held up the eviction.
