A retail company that I used to work for and still shop at has filed for a chapter 11 bankruptcy. Today I received a Offical Form 309f in the mail, I don't know if I need to do anything. I have no sticks or financial intrest in the company, no 401k or stocks. The forms were addressed to me an not my wife whom has a credit account thru them; which is held by a third party financial institution. I after reading thru the pages a few times it seems like it may just be a formality thing that since I did work for them I'm getting this as a notice but I want t make sure. Thanks in advance.
My guess is you received this notice as a former employee because it was assumed you might have had an interest in the company pension plan. Since you do not believe this business owed you money, you have no obligation to do anything. If you did think you are entitled to something, you would need to timely file a proof of claim to document what you are owed. Hope this perspective helps!

Somehow your name and address was given to the court as someone with a possible interest in the company and the bankruptcy. Sounds likely that it was a formality, but the only way to be sure is to see how your name comes up on their paperwork. You may be able to all the law firm that did the case, speak to a paralegal, and see what they show you as. If you are not owed money, you don't have to do anything. If they think you have some greater involvement, there will be more papers coming your way in the future, but it sounds like you have nothing to worry about.

You should also consider whether you have any legal claim against the company arising from your employment as a potential reason for the company to list you as a creditor. But I agree with my colleagues that you should, at the very least, have a conversation with the company's bankruptcy attorney.
