My husband and I are getting a divorce and I want custody of our son. He has been living with me full time for a year and my ex and I separated almost 2 years ago. I have my own house and my ex lives with his parents. We've had an arrangement, based on multiple variables, where my ex would come to my house when he was off work to bring my son home. He didn't trust his mom to not smoke or drink in front of our son. Now my ex has done a complete 180° on our arrangements and keep changing his mind/gaslighting me. We've had a babysitter for almost 2 years who watches our son, because my ex didn't trust his mom, or dad who doesn't have patience with kids, to watch our son. My ex changed his mind about the babysitter, because he doesn't want to pay them, and wants his parents watching our son. When I tell him I don't want his parents watching our son, he says that never happened. He wanted to claim our son for his taxes but when he learned that he needed to have our son more, all of a sudden he wants to keep my son there. We have court on Jan 23 and I have the child custody/support papers filled out but not turned in because I just... don't know what to do that would be best for my son
You will need to file a Request for Order and provide a factual declaration as to why it's in your child's best interest to be primarily with you; you have established a status quo but it isn't reasonable to demand that the father come to your house. He will get at least visitation.
