I am currently planning on movie from California to Hawaii. I asked my General manager to contact the GM at the Hawaii location to move me over there. I am concerned that they may say it's fine but when I get out there that the GM in Hawaii says oh I don't need you now. What can I do to protect myself to secure a job and guarantee me that I won't go out there and be blown off.
Get it in writing. Short of an express agreement that gives you some kind of guarantee of employment for a period of time, you will be subject to the at will employment relationship that allows an employer to terminate and employee at any time and for any lawful reason, or even no reason at all. The only only recourse you might have, and it is quite a narrow exception so it is hard for you to rely on its availability, is if you are given unconditional oral assurances of the job and when you arrive it is not there. Under that situation, you might have a claim for estoppel which would give you some rights. However estoppel would not protect you against becoming employed there and then terminated shortly thereafter pursuant to the at will relationship.

You should also take a look at Labor Code Sect. 970 which makes it unlawful for an employer to misrepresent the facts of an employment in order to entice an employee to relocate or move either witin the State or outside of the State to take a job.......this section may or may not apply in your situation if you are an existing emplloyee however, bottom line.....I agree with the others.....get it in writing........Stephan Math
