name is Almaz. here is my issues.I and my boyfriend had 2 children together. Our kids benefiting Medicaid from state t because I can't afford for their health insurance. I'm home I don't work. I and my boyfriend some times have an argument and separate for the time being. He provides, shelter,clothing ... but renewal came and applied and asked me to apply child support. He is providing to his kids and why would I apply for child support. Then they send me court citations for hearing.
If you and your boyfriend have separated, and the state provides assistance for your children, such as Medicaid or TANF, the state will want reimbursement of cash medical support and any TANF so you have to cooperate to receive those benefits. You and the other parent either have to solve your problems and be in one household or you have to have a court order protecting the state's interests. You perhaps can have an order that only addresses medical support if no TANF is involved.
One of the requirements for accepting Medicaid of behalf of children is to establish child support for those children, unless there is "due cause." It is an effort by the State to push parents to be financially responsible for their children (by obtaining an enforceable court order that establishes child support/health insurance provisions), as opposed to simply sitting back and receiving public benefits (which tax payers fund). If you do not obtain a properly executed "just cause" waiver or get child support established, then you could be denied the Medicaid benefits for this children. The fact that you and your boyfriend are working on reconciliation has no bearing on the fact that the State of Texas and the federal government are providing benefits for your children that your boyfriend is not providing. If you are not living with your boyfriend and accepting Medicaid benefits, then your boyfriend should be paying child support to help you financially care for your children. If you do not answer the citation or appear in Court after you have been properly served with Citation and Notice of Hearing by a Constable, Sheriff or process server, the State will eventually move to dismiss your case and start to investigate your benefits. You are running the risk of losing your benefits unless you cooperate with the State and seek child support from the father of your children.
