my car was confiscated by the shelby county sheriff's. It's in my mother's name. She is 75yrs old and I do not to evolve her. My boyfriend took my car and the police say he committed a felony in it. They say I will get a letter telling me how to get it back but that it could take a week or two. They did not give me a receipt . Just a card with the detectives name and phone number. I need to know what to expect. And how to prepare.
Yes for the reasons I stated on your other post. By the way, don't respond with comments discussing facts--this is a public site and DA's can look at it too!
You will have thirty days to file a claim if it was confiscated by the police under the forfeiture laws of the Tennessee Dept of Safety Since the vehicle is in your moms name ,You should file the claim to return the vehicle under her name not yours.this process could take quite a bit of time so I would advise you to hire a criminal defense attorney to try to get it back as soon as possible,Your mother more than likely has a good defense to get the car back since she more than likely had no idea your boyfriend would possibly commit a felony with her car and without her permission! If she can't afford an attorney she cans file under an indigent claim which the paperwork you receive should explain how to do that. Good luck!!!
Your car was taken in the most crooked racket in this state. You will need to get a lawyer and get money to buy your car back. The police will offer to sell it to you before selling it at a police auction.
