I was traveling about a month ago in the left (fast) lane. The right lane had some backed up traffic and a woman swerved out to avoid hitting a car in front of her and she sideswiped me. It took two and a half weeks to get an accident report. After I got it its been another two weeks just for Allstate to tell me they not accepting liability for their insured hitting me because there was another car that cause her to swerve into my lane. There was no information on that driver in the report and they were issued no tickets and left the scene. But I was told by the police she was liable because it doesn't matter what made her swerve if she was paying attention she would have had adequate time to stop and she admitted to jumping lanes and hitting me. My car has been totaled and I owed 9000+ on this car. I have no rental and now way around as I only had liability insurance...I'm pretty screwed up here. Thanks in advance for any responses.
You show up for her tickets and object to pleas. You sue her for the damages.
