Our landlord just had a forceable inspection on 3/23/17. At that time, she gave a letter to my husband advising she would expect entry on the 1 st of every month. However, everything we've read states, there is still a requirement for 2 days notice as one notice does not serve as multiple notices. Is this correct?
A.R.S. 33-1343 of the Arizona Residential Landlord/Tenant Act covers this issue. You should read it. Subsection D of this law provides that the landlord shall not abuse the right to access or use it to harass the tenant. It seems that monthly inspections are excessive. The law provides that at least two days' notice is required. If you object to such frequent visits ask her why such is necessary. Perhaps work out an agreement for inspections every 4 months or so. If she persists and you are on a month to month lease give 30 days notice and move or tell her that you will not agree to such frequent inspections. If she tries to evict you for such refusal a judge may agree with you as monthly inspections in the absence of a good reason may be excessive or harassing.
