My spouse is in a custody case. She called dcfs for a bruise on his leg that was there prior to him coming over. So of course they came and interviewed and said he was unfounded. This is getting ridiculous we have paid so much in lawyers in the past and nothing is getting done in this case.
You haven't really stated any facts other than 1 dcfs report that was unfounded. Additionally, if you have an attorney, your questions should be directed to that attorney. Custody cases are complicated and always take longer than you think they should
Custody cases are almost always battles. They take forever and costs a lot. Just for the record, they cost a lot not because we're mean and greedy, but because they take a ton of work and no one ever agrees on anything. Therefore, long and expensive.
There are no facts to base an opinion. Sounds like you have an attorney; ask them. Otherwise, get one.
Your posting only asks a broad question with few facts. It is not possible to answer your question of what to file. If your spouse has an attorney your spouse should make an appointment and get specific advice on the status of your spouse's case and what could be filed if anything. If your spouse does not have an attorney then your spouse should consult with several experienced family law attorneys to get a few opinions based on fuller info and follow the advice of the attorney your spouse likes best.
