There is no such thing as "damage and repair on my side". If you obtain a written report from the plumber saying that the damage is being caused by other tenants, you can use that to make the landlord responsible for the repairs. Technically, you can file a complaint with HPD (call 311) and then an action in Part B of Housing Court. Practically, if the landlord is having issues with those tenants, it will be a long long time before he can fix the issue, even if he truly wants to. Best of luck!

If the leak is coming from your neighbor then your neighbor is liable for all damages. If he refuses to address the situation you can sue him, repair the damage then sue him for the cost, or put in a claim with your insurance company and they will seek reimbursement from the neighbor.
