my son has a 3 yr old son, he was told yesterday by baby's mom to take him so that he will know what its like to care for child 24/7 and because she is being evicted from her apartment.she gave my son 2 bags one with dirty clothes and one with clean clothes
In my opinion, the route here would be for your son to file a Petition to Establish Paternity in which he seeks majority timesharing with the child. Until that's been established, he has no legal rights to the child and she could come at any moment to demand the child back.

I agree that your son should immediately file a Paternity case to be named the majority (e.g. custodial) parent. If he and the child then reside with you for 6 months, you could then petition the court for grandparent custody. I would advise you to quickly retain a local attorney to help you with this complex matter.
