I have a YOA( youthful offender Act) burg 3rd degree in Berkeley County,South Carolina. Got charge when I was 17 years old(2008) but got convicted when in 22 years old(2012). I did no jail time, just Restitution and Probation. I was done with probation/restitution July-September of 2016. I trying to get my record expunge but they telling me I have to wait five years before I can get it expunge. Is they any way to cut that time in half or bypass that time period. I'm 27, I can't wait to 5 years,I will be 32. I'm currently in school and about to graduate college.
No. That is a requirement by law. The court lacks the power to grant the expungement until that time passes. The purpose is to be assured that you learned your lesson. If you cannot stay clean at least 5 years, then there is no point granting you the do over. The state is more interested in keeping your record to use against you on round 2.
I agree with the prior answer. When you are close to the time running out you should find an attorney to work with you to help you navigate the process.
You are being given the correct answer. An expungement can take up to 5 years before one is eligible. The Court wants to be more certain that you will not offend again.
