I have been waiting on my w2 the whole month of January. I knew the employer had til January 31st to send them out. After I didn't receive it I called February 5th and asked could I get another copy she told me to call back on today which is the 9th I called and got nothing but attitudes and people hanging up in my face. I finally talked with someone and she told me there was nothing they could do that I would have to wait until the end of February once their software or something is up and I could download it online. That can't be legal can it? What am I supposed to do for a whole month? I have kids and I'm out of work. I trued emailing the company, no response,I can't even find a corporate phone number please help.... I live in Memphis Tennessee the company is in Southaven Mississippi
I do not specialize in taxes, but from a brief search, here is some information I found that may be helpful:
If the employer does not send the form to the employee by Feb.15, you should ask the IRS at (800) 829-1040 to demand the form from the employer. The IRS will then tell the employer that it must provide the form within 10 days or face penalties.
When you contact the IRS, you must be ready to provide the following information:
•Your name, address, city, state, zip code, and Social Security number;
•Employer’s name, address, city, state, and zip code;
•An estimate of the wages you earned, the federal tax withheld, and the period your worked for that employer.
The IRS will then contact the employer and direct the employer to file the W-2 form. The IRS will also warn the employer of penalties if the W-2 form is not sent.
If you still haven’t received your W-2 form within a reasonable period of time, you may need to use Form 4852, Substitute for Form W-2, Wage and tax Statement. Attach this Form to your tax return. You may want to speak to a certified tax accountant for assistance in filling out Form 4852 and to estimate income and withheld taxes.
