I have a contested relative adoption case to where my father & his wife are trying to adopt my 2 oldest children...I'm currently seeking a lawyer however, in the motion they filed, both allegations (regarding me not contacting them or paying child support) are false and I can prove it...my ? is...what else can I do? Other than having a lawyer contest the adoption... Contempt of court or slander, anything?
There is no slander claim, because court filings are privileged--they can't be the basis for defaming someone. It's extremely unlikely that there would be a contempt of court finding. Many people overplead their case, and you would need to prove way more than that they're false. It would have to be completely without any basis and malicious. But it does make them look bad when they don't have any proof for what they're alleging. I do suggest that you do retain counsel, since this is a complex matter they you shouldn't even try to handle yourself.
