My son is 6. At P.E class yesterday he was hit in the face with a jump rope by another student. My sons front tooth was knocked loose and bled profusely. He ran to the teacher, where they handed him a tissue and tried to yank his tooth out (without calling me, without my sons consent) he was not sent to the nurse and i wasn't called. he went all day with a painful loose tooth and bleeding mouth. His main teacher confirmed that was what happened but didn't see a need to call me or send him to the nurse. My son has dental caps on that tooth. its surgically implanted and glued to gums, so the teacher couldn't pull it and damaged my son further. spoke to principle and she is trying to lie and say teacher never touched him. and that my son never told anyone he was bleeding or hurt. I have talked to 2 other moms, their kids witnessed the incident and confirm what my son said. i have pics of my sons face. I picked him up from school with a blood crusted mouth and a broken (dangling tooth). I am mainly upset that i wasnt notified my child was bleeding profusely, that a teachers aid played dentist with my son and reached her dirty hands in his mouth and caused him harm-good intention or no
I would contact a local attorney with litigation experience to guide you through the process. If it is a public school, then a notice of claim will need to be provided to the school in order to preserve your claims. Regardless, you will need to determine exactly how your son was damaged (go to dentist and see what damage was done to tooth), and have the attorney address it in a demand letter to the school.
