I pay real life money to play a free game to get in-game upgrades/items (this is probably key element). There has recently been a lot of issues with the service and gaming system that has required me to put in trouble tickets. Now its been over 3 months with no resolution on 1 ticket submitted (they said it was resolved when it actually hasn't), its been over 6 days now with no reply from them regarding a new ticket I submitted and still counting.

Customer service is a constant problem for online gaming sites, especially when they expand rapidly.
There is no way to tell whether or not there has been actual resolution of your problem, inasmuch as you don't describe the problem nor the gaming site's response. If you have been simply purchasing gaming aids (I therefore presume this is not a gambling game) then it is highly unlikely that the amount of money in question justifies retaining a lawyer's services. But remember this: you can always vote with your feet. If that gaming site won't give you satisfaction, then remember (and remind them) that you can always go someplace else.
Probably the best thing you can do is read carefully your Terms and Conditions page, then try customer service again.
