We just purchased a car. The HOA usually does car permits at a certain time however i had to leave for work in hopes of calling them the next morning to get it but my car was already taken. We did not park it in guest parking for obvious reasons. I've been going back and forth with the property manager and she's telling me the towing company will not issue a refund because they technically were following rules. I understand that but what can I do?
Nothing. You should have made arrangements prior to the purchase of the car or parked it in guest parking. I don't know what the obvious reasons were you are referring to, but it is not an excuse for breaking the rules. The HOA has no authority to tell the towing company to issue a refund. The HOA has a contract with the company and the company performed the work.

I agree, sorry but technically you broke the rules and got towed for not having a permit and did not park in the guest spot until you got one, or arranged to get the permit early or otherwise somehow. There is nothing to do if you paid for the tow, they sound legally correct.
