I was awarded primary physical custody and sole legal custody in California in 2015. On 5/1 we were both charged with domestic violence and assault over a dispute which was not due to my aggression, the judge at the arraignment however dropped the mother's (TM) charges to disorderly conduct and put a GPS tracker on me not allowing me to return to my home. We were both arrested at the same time but TM's family took it upon themselves to take our daughter and keep her until TM was out, now even though I'm the parent with primary custody I'm not able to see my daughter because I can't have direct contact with TM. TM has communicated to my mom that she won't allow me to see my daughter because she doesn't trust me. This is the longest we've been apart since my deployment when she was an infant.
My daughter figured out she can contact me through google hangouts on her tablet but now TM won't allow that because she claims I'm confusing our daughter, which she told my mother. What can I do about this? I'm 100% confident her actions are out of spite towards me and it's starting to severely affect my mental state to the point where I can barely eat. I have call recordings from my mom.
This does not appear to have an immigration element to the inquiry. I am changing the practice area to child custody.
