My husband and I are currently separated. We purchased a vehicle last year and he agreed to make the payments. This hasn't been an issue until this year when I have made the last several payments. I have asked for the truck back, but he refuses. I realize if I do not pay the vehicle payments, the truck will be repossessed. How do I either transfer the vehicle to him to alleviate me of the responsibility or get the vehicle back?
Unfortunately, the answer is by agreement. If you are separated this should be part of a property settlement agreement - who gets what, who pays what. Otherwise, you are both joint owners and joint debtors. Consult a domestic relations attorney to review your options. Many listed on AVVO offer free initial consultations.
