Girlfriend was in accident and my truck was totaled by Gieco policy holder was at fault for failing to yield and was ticketed I called Gieco for a rental car and their saying my girlfriend was 25% at fault and their only paying 75% of thr car rental and the 75% for the vehicle I refused the offer
Most insurance companies have provisions, usually arbitration, for policyholders to avail themselves of when they dispute the insurers position.
You can refuse the offer. Hire a personal injury attorney to negotiate and/or litigate the case. In the interim let your carrier handle the damages. They will have a subrogation lien and collect from the settllment.
Go with your insurance and be out 500 for now or what ever your deductible is. If she's hurt get a PI consult, its free to do that.
