I’ve lost custody of my son 7 years ago due to a job loss. I took it back to court to try and regain custody and lost again. I’ve never won anything where my kids were concerned. My son has clearly been physically and mentally abused over those 7 years. He’s now 16 and wants to come back home. What can I do as his mother? I get calls all the time where he’s breaks down crying. I have four younger kids that live with me also. This judge we’ve had over the years is very biased. My ex brags about growing up with his kids...
If you believe your child is being abused or neglected, you are required to contact the Nebraska Child Abuse Hotline and report the abuse. If the abuse is confirmed, this can help support your request for custody. If your report is found to be unfounded, then this may be evidence used against you in your modification action. As the child gets older, the more weight is put towards where the child wants to live. You may also want to see what you can do to improve your child's situation even if you don't have custody of your child. This may include counseling for your child, switching the child's school, etc.
Although I am an attorney practicing law in Nebraska, the answer I provide is for general purposes only and does not establish an attorney-client relationship. If you need legal advice, you should contact an attorney who will discuss with you the specific facts of your case.
