A Debt Collector has been harassing me by mail and by having papers served to my home. I voluntarily surrendered a vehicle in 2015 back to the bank. The bank has hired a Debt Collector listed as a Law Firm based in Golden Valley, MN. I am disabled and am not able to pay the debt (interest left on loan after vehicle was sold by bank). I've tried to explain this to the Debt Collector, but they persist on harassing me.
Under the fair debt collection practices act you have the right to tell them to stop calling and stop writing you. Tell them verbally, and put it in writing, registered mail return receipt requested, and be sure to keep a copy. If they violate your instructions, make a complaint against the lawyer to your state bar association, and also at the same time consult a consumer rights lawyer about potentially suing them.
Now, for the other hand. If you leave them no avenue to communicate with you, they have two choices: To drop it, or to sue you.
