so i currently was forced to move out of my apt due to the fact that my landlord shut off my electricty then my water and finaloly my gas over the period of little over a month now, the building was owned by her and her mother, she now claims that she no longer owns the building her mother does, her mother called me restricted saying that the building has been sold and that i need to vacat the property. i have no contact infromation for this lady and prior to everything being shut off i owed $100 in back rent since the shut off i havent paid anything towards rent. i also have a 700$ security deposit i have not received, i have not yet returned keys to the apt but i have moved all my stuff out and have left the apt clean and with no damanges. i have two children and akll of this has caused many problems for us, there was a call placed to social services saying that i was living in a home with no utilities and imk pretty sure that was from my landlord cause noone else knew i was without power. So im wondering what i can do and how i go about doing it? thank u for ur time , oh my name is Malina and i live in Colorado
Who did you pay your security deposit to? If you don't receive the deposit within 60 days, that is probably the person you will want to sue to seek recovery of the deposit and treble damages (total of $2,100). Their claim that the property has been sold shouldn't matter unless they can prove that the deposit was transferred to the new owner and file a third party complaint against them. You will need to provide proper written notice before you file a lawsuit if you want to recover treble damages.
If you cannot find that person, that will be an issue. You will have to decide whether it is worth the expense to hire a private investigator to track them down.
