I was terminated from my job December 18th 2015; I was told that my position was being terminated due to department deficit; and the decision was determine according to seniority. As if today my previous position is reopen and posted in their website; I feel betrayed . What to do?
You should go consult with a labor employment in your area. There are not enough facts to give you an answer on whether there is some type of employment discrimination going on. Generally, Florida is an at-will state, and you can be fire/let go any time with reason. You could just apply for the job and see what happens.
What interests me is: Did you apply for unemployment compensation on the basis that you were laid off? If so, did the employer contest the unemployment claim? Have you considered applying for the position that is being advertised? These are questions that you would want to discuss with an employment attorney in Gainesville, before you make any moves.
The facts you provide may suggest that the reason given for your termination is false. That, by itself, is not illegal. However, if the real reason you were fired was due to a legally protected characteristic (eg, age, gender, race, etc.), you may have a claim. Contact an employment attorney.
