I got in trouble for embezzlement as a misdemeanor for 970 dollars and i want to know what could happen in court and if i could go to jail for this. This is my first time i get in trouble.
You need to get a lawyer to help you because the conviction is worse than the punishment. You probably won't go to jail, but you might do a bunch of work release. They'll want the money back. Bottom line, the theft-related conviction is devastating. Get a good lawyer to help you and shoot for a civil-compromise if possible, although that's a long-shot in Riverside County. Good luck to you.
SAN DIEGO CRIMINAL DEFENSE ATTORNEY--20 years experience
Good that you do not have any priors. However, this is very serious, and is subject to jail, but as Mr. Finnecy has stated, there is a good chance you could avoid jail because of your first offense. You will almost certainly be on probation and it will cause a bad record for future employment opportunities.
On the other hand, if you are innocent or for whatever reason you want to fight it, you have the right to go to trial. Chances are that you will get a deal that is better than the risk of trial. Contact an attorney in your area right away.
You can go to jail for this. The top priority for you should be setting aside or borrowing $970 to make sure the victim is repaid. It this happens, the rest of the deal is far better and less punishing - maybe no jail. Hire an experienced criminal defense attorney who regularly appears in the courthouse at issue. Best of luck to you.
