I broke up with my boyfriend who is my son's father. What custody rights does he have? He is trying to take my child from me.
One of you should file a paternity suit to acknowledge his paternity to the child AND to determine rights and duties of a parent, child support and visitation. I'm going out on a limb and suggesting he may not want to take the child. Rather, he's acting childish and trying to hurt or scare you. Hire a lawyer to do the suit. Unless you're a sorry parent, you won't lose your son, you'll have control over when the dad can see him and importantly, you'll get child support.
I am not intending this to be legal advice, because I don't know the particulars of your situation.
