I am living with MS and other ongoing chronic major health diagnoses that render me unable to work. I am indigent, living in my aging parents' home. My NC Medicaid disability application was denied at the county and state levels of appeal. The next step is to petition for an administrative appeal at the Superior Court level. I cannot find instructions on how to do this. The Clerk of Court advised that I needed to hire a lawyer. Legal Aid cannot help at the Superior Court level and I cannot find an affordable attorney through the NC Lawyer Referral Program. The petition is due no later than midnight tomorrow 12/11.
this article will help
You will have to file a petition for review with the Clerk of Court. there is no form for this...it needs to be drafted similar to how a complaint for a lawsuit is drafted from scratch. These are very difficult matters which is why you might be having trouble finding an attorney. I hope you have also filed for social security disability as well.
And 1 correction, the petition is due tomorrow at 4:59, not 11:59 as the clerks office will be closed.
