My husband and I have a notarized domestic partnership in an affidavit created in 1995 in California. Six years ago we married, but our relationship has existed for 22 years. For the entirety of that time we presented in the world as husband and wife including in the purchase of property and a name change which blended our surnames, and the wearing of wedding bands. I have been primarily a homemaker and stay-at-home mother since our first child was born 20 years ago. Now we are divorcing and my husband is claiming he has no financial obligation before the 6 year marriage because our domestic partnership was not regitered. However in 1995 there was no mechanism to register it. Do I have any legal claim for support regarding the time prior to our marriage?
None. At least, legally. I highly recommend mediation or collaborative divorce.
