What are the penalties for petty theft in Florida?
1 attorney answer
Depending on how it was charged, it could be a 1st or 2nd degree misdemeanor. Second degree is where it should be filed at, which is punishable by up to 60 days jail and a fines. You really need to sit down with a criminal defense lawyer who regularly practices in that county. They would know what options to have, and the cost of a lawyer might make it so you do not have a permanent record. At the minimum meet with a lawyer and see what options you have. In my county court, I would feel fairly confident in saying you would not likely have to spend time in jail, but that is the county I practice in. You really need to meet with someone who can give you a similar expectation for Cocoa FL.
