I've been battling my ex-husband for almost a year now and he will not give consent. I have been in TX since late 2009 but was not financially stable to relocate my daughter until a year ago. During that time, she was residing w/ my family until about a year ago when his girlfriend moved in with him. Because his girlfriend & 4yr old daughter moved in, he now had someone to watch our daughter while he's working. (My ex-husband is a police detective therefore he has to work rotating shifts weekly.) Our 8yr old daughter does not want to live w/ him; she has only been living w/ him for a yr. A mediator was ordered to seek with whom my daughter should reside w/, either myself in Houston,TX or w/ my ex-husband. The mediator declined my request for relocation but we are still awaiting tria
Do you have an attorney? Mediators do not decide anything. Their function is to help the parties broker an deal or reach an agreement. If you want info on LA law, call your former LA lawyer and ask for advice. However, generally speaking, if there was nothing in the prior order that restricted the residence of the child to a particular area, there is no reason you cannot move to TX with your child. I advise you to get an experience family law specialist to help you with the custody issue if you don't already have one. Check out my experience as an example.
