I'm a full time passenger in an over the road semi truck. I don't have a CDL, don't drive the truck.
I don't smoke inside the truck where the driver can accidentally inhale, there's no trace of it inside the cab. Aside from some edibles, it's completely consumed/smoked outdoors away from the driver.
I know for the driver, it's 100% illegal. I also know that the federal government recently decriminalized it on the federal level- leaving each state to make it's own laws & regulations.
As a passenger in a commercial vehicle, I know some rules apply to me as well as the driver.
I do not know the answer to your specific question, but I can’t tell you that the federal government has not decriminalize marijuana at the federal level. It would be a whole lot cooler if they did, but it has not happened at this point. My guess regarding your specific question is that the CDL holder could still be in a lot of trouble if he was found to have a passenger who was holding in the cab with him.
