An eviction has been filed against me for nonpayment of rent. I have had a pipe leaking in my bathroom ceiling for over 5 months causing mold in my bathroom. My landlord has been unreachable.. phone number listed on all paperwork is (999) 999- 9999 address is listed as my address but there is no landlord on site.. I haven't gotten responses through the web portal and have not spoken to them in person in three months.. Emails were rarely responded to. And although maintenance has been in my house several times in the past few months, they can't correct the problem.. I have video of water draining through the opening used to get to the A/C unit... my bathroom floor is frequently covered in about a half inch of water. Not paying my rent has not caused them to reach out to me.. I had to knock on my neighbors door and ask if she had any phone number I could call.. she gave me a flyer for an open house at another property with the same management company... when I called all she had to say to me is, "you can tell the judge that". This is a company that has taken over in the past 6 months so I don't know where their office is located.. My question is, can I fight the eviction?
You can fight the eviction but I'm not sure how effective your defense will be. Even when things are not working properly there are certain steps you must take to protect yourself. I will post a website to the Texas Property law for LL/Tenants that you should be able to review to find the answers you need. Good luck to you.
