I am wondering what the legal codes in the State of Michigan to quash a subpoena order to appear and/or produce. I am currently unable to appear or produce any of the requested records and im out of the country. So what codes can I use to quash this subpoena and arrange other actions?
There really is not any legal "codes" in such a situation. But you need to file a Motion to Quash the Subpoena with an answer denying that the requested records are in your possession. If you are out of the country I reccomend that you retain an attorney to file the motion. Although that attorney will need access to you.. a simple telephone call to the opposing counsel may allow him or her to delay the appearance and production until you return and can do it justice.
