My ex husband left me and my kids in 2000. He married an american citizen even before he left me. I was told we were divorce already and that I cannot do something about it. Since then he stopped supporting our children..I moved on. I have been requesting my divorce copy but they ignored me. I move on and just work hard to provide for my children. In 2002 I met somebody and he offered to marry me in spite of my situation. We weren't able to get the chance to see my divorce decree..no time to wait he was in the army and set for deployment. We got married in August 2002. I hired a lawyer for some legal help also to get action in getting my divorce decree because I couldnt find it on the Illinois record. My lawyer sent him an ultimatum if he dont cooperate. Then 3months after he replied with the divorce decree only he just filed it thru publication and just entered in Nov of 2002. And because It shows that I got married before the divorce I have to spend so much for lawyers. And obviously when they file for his petition they did not provide the right document. He was petition in 2000.

Although AVVO describes this site as providing free legal advice, it is really a simple Q&A forum. The volunteer attorneys provide general answers. No specific legal advice is given here and no attorney-client relationship is established. For precise direction and legal advice, please consult in person with an attorney in your area. Be sure to bring all relevant paperwork with you.
You should focus on your own situation. According to your fact pattern, you seem to have married before you divorced. In that regard , I suggest that you seek personalized guidance.
Based on the information that you have provided, it appears that your second marriage is not valid. This is a serious situation. This is not a problem that you will be able to solve on this online forum. You will need to hire an experienced family law attorney and, possibly, an experienced immigration attorney to resolve this situation. It is not clesr if you need an immigration attorney because you do not state in your question if you were already a U.S. citizen back in 2000, when your ex-husband left you, or what your own immigration status has been at present and in the past. It appears that your ex-husband's second marriage may also not have been valid, if he got married to his second spouse before he obtained a valid divorce decree for his marriage to you.
Please schedule consultations with a family law attorney and with an immigration attorney for additional information and assistance.
