Ok so my fiancée has been charged with his 4th domestic violence charge and was sentenced to 1 year in county. I am the "victim". Now I got a command to appear in federal court to testify (either for or against him). Seems this makes him a 4x habitual offender what's that mean for him? Hes already sat 36 months in federal prison for domestic violence.
Being a 4th offender with respect to any offense is never good for the cause of freedom. Your facts do not reveal why he is serving time in a federal prison as opposed to a state facility. He really needs to consult with a qualified criminal law attorney for a complete answer based on all the facts and history involved.
I am not aware of a case where the feds charge defendants with domestic violence. It sounds as if he has some other federal charges that you may or may not have been a witness to. Before talking to anyone you should hire a criminal defense attorney. He or she can determine the government's interest in you and if you should cooperate. Good luck.
