I was stopped at a stop sign at a T intersection. No electronic traffic signals, no streetlights on either single lane divided road.
I saw headlamp's from two vehicles coming from my left, waited for them to pass. Checked my right and left again, saw no headlamps or vehicles coming from my left or right and proceeded into intersection to make left turn and was struck, left rear passengers door. My car was totaled and towed, bumper damage to other vehicle drivable from scene, no injuries claimed at the scene by either party, no passengers in either vehicle, no witnesses. It was 2/14/2018, night, dark, overcast, no street cameras or vehicle cameras. I informed the police officer, the driver that struck me did not have the vehicle headlamps
on and I could not see her black vehicle under those conditions. That information was not in the police report narrative. My word against hers? Is my credibility as a former police officer, traffic accident investigator a help or an issue? I will plead 'not guilty'. What defense argument would be successful in a finding of not guilty by the judge under these circumstances at the bench trail?
The other vehicle not having headlights may be a decent defense, but your chances increase with a lawyer.
