In March I found a house for rent on craigslist. Owner stated home would be available April 1st . I gave a check $2100 for the deposit(1months rent) plus the first months rent. That the 1 month rent was just for security but we would only pay 1/2 the 1st months rent. The check was cashed immediately. March 30th I was told the home won't be ready until 4/15. 4/15 he called and said May 1st or 15th tenants had not moved out. Owner went out of the country. On April 29th tenant stated he would move out June 1st. on 5/27 I had not heard from any one. I sent a text stating I wanted my money back. He told me I could not get my deposit back. That the house would be ready June 1st. He assured me it would be. On June 1st the tenant said she left the key at the house.The house is not in conditions to move in. Not yet painted as agreed, nor floor fixed. trash, mold and mildew all over the home. etc...Owner insists that I have it cleaned and anything fixed and send him the bill. He is out of town. I still have not signed a lease. I have no home and cannot move in this home. I just want my money back.
I suppose it would have been better for you if you had a signed lease that included the move in date of April 1, but it sounds like there has been no lease signed. If the LL will not agree to refund all of the money, all you can do is sue him for a full refund based on his breach of the verbal agreement. That is likely a good case for Magistrate Court and it must be filed in the county where the LL resides. The amount in controversy does not likely warrant the expense of hiring an attorney to represent you. Next time, do not pay any money until you have a signed lease/contract.
