I had a City Official to turn left in front of me causing an accident in the middle of an intersection. The 1st officer that came out went over to the City Official 1st. Next, another Officer with a K9 came out and parked behind my son truck at the light, which I was driving. The 1st officer then came over to me and ask was we alright and I told him no. My knee had swollen from hitting the bottom dash on the driver side. He then asked if he needed to call the Ambulance, and I stated yes. The K9 Officer spoke with the 1st Officer and he explained to him what the City Official had told him. Then they walked over to me and ask what happened. I went to tell him then the 1st Officer said he smelled 80 Proof, then the K9 Officer said me too. The next thing the K9 Officer says is that he smell Marijuana. He asked to search me and I allowed it, then I went to remove my purse and he told me to leave it in the truck. He then went to get the K9 dog and ran the dog around the truck 3 times. Then he started searching the truck and after that my purse on top of the other officer patrol car. I filed a complaint and had to do a response to the complaint in Dec. because of no response.
While I see your suspicion here, there is no obvious misconduct. Were you cited for DUI? What was the misconduct aside from you being suspected of DUI? You have a lawyer for the accident, correct? Have you made a claim there?
If the officer dis not do anything but search you then you probably do not have a civil rights claim. But you may have a claim for the accident.
