Relocated to CA in 2007, primary home left behind in GA went through short sale in Aug 2014. Junior lienholder (HELOC) on short- sold property has now placed loan with a collection agency. Can collection agency seek judgement through GA courts and have it enforced in CA where I presently reside, or do the CA deficiency laws supercede whereby junior lienholders cannot seek deficiency judgement once they consented to short-sale.
In most property cases the law of the state where the property is located will control the issue. So yes if GA allows a judgement and the lender obtained a judgment they can enforce it in California.
